NIS2 directive since October 2024

What is the NIS2 directive?
In January 2023, the second EU Network and Information Security Directive NIS2 came into force, replacing the previous NIS Directive NIS 1. Its aim is to strengthen the security and integrity of networks and information systems in the European Union (EU) and to protect companies and public institutions from cyberattacks.
Compared to the NIS 1 Directive, the NIS 2 Directive expands both the group of companies affected as well as their obligations and the extent of official supervision. The penalties and sanctions for violations have also been significantly tightened and are now based on those of the EU General Data Protection Regulation (GDPR).
The EU member states had to transpose the directive into national law by October 17, 2024. In Germany, this was done via the NIS2 Implementation Act.
Which companies are covered by the NIS2 directive?
Current estimates assume that between 25,000 and 40,000 companies in Germany will have to implement the NIS2 directive. These are no longer just obvious operators of critical infrastructure, but also food producers and retailers, financial institutions, online marketplaces and companies from the waste disposal sector, among others.
According to the current draft of the NIS2 Implementation Act, the requirements for these companies include, above all, “taking appropriate, proportionate and effective technical and organizational measures to prevent disruptions to the availability, integrity and confidentiality of the information technology systems, components and processes that they use to provide their services”.
